As part of the fallout for the lawsuit brought by Jonathon Turley and
company against the government on behalf of Groom workers, the
President had to make an annual determination exempting Groom from EPA
reporting requirements in regards to toxic materials. This was done
on the basis of national security. This was an annual event, usually
done in September, and published in the Federal Register. The first
exemption was made in 1995 by Clinton, then renewed annually by
Clinton, followed by Bush.
Up until 2003, that is. The last Presidential Determination regarding
the "... Air Force's Operating Location Near Groom Lake, Nevada" was
made on September 16, 2003 and published in the Federal Register
October 21, 2003.
So what happened? Did something official get filed stating that they
no longer had any reportable toxics on site, thus no longer needed the
Presidential exemption? Or did somebody just forget?
