There is QUITE the discussion regarding this, seems Crunch3r used a
program to tweak the Berkeley software. According to some if he then
deletes that program we can no longer use his products. Got to do with
Copyright and how WE don't own, the program he used, it but only use

The purchaser of software *usually* purchases a license that states
what they may do, or not do with the program.  It is not something
that comes "after the fact" and copyright is something else.

on this, but understand that as I am not a lawyer I can only go on
what I think the law should be, not what the law actually says.

Seems to me, the layman, that if you have a product you can do with it
as you like, but apparently that is NOT true! ESPECIALLY when it comes
to software.

Copyright only protects the intellectual property, it says nothing as
to how you use it.

HOWEVER It does depend on the "original" soft ware license and
conditions.  If the original came with a license and conditions the
user is legally bound by those conditions. Unless stated otherwise a
program is copyrighted, but... it all depends on that license
statement and conditions. Nearly all soft ware comes with some such
statement that contains the conditions for termination of the license
agreement. 

What does the license agreement say? That agreement should tell the
user how they are bound whether they read it or not.
