If this is the case and you are referring to the BOINC version, the copyright
licence from Berkeley is void for that version and always was, so it is
illegal for him to distribute the binary and anyone receiving is not
receiving a lawful copy.

The classic version's licence unconditionally forbids such variations.

Not so, according to Berkeley; the SETI@home open-source software is 
under GPL--see the notices that came with the S@h app in your projects 

to stop you _using_ it. And no-one modifying such open-source code has 
the right to impose additional conditions on the licence.

And, if another licence applies that does impose such conditions, the GPL
licence is void and the right to distribute is forfeited.
