Subject: American Computer Company sues an Oklahoma Photographer/
self-described UFO Investigator in Supreme Court
Date: Sat, 21 Mar 1998 01:50:35 -0500
According to the COURT RECORDS of the NEW JERSEY STATE SUPREME COURT:
American Computer Company has reluctantly sued Lan Lamphere and his
Web Business in Supreme Court in New Jersey for charges including
libel, inciting others to commit violence and a number of other
Counts.
According to information obtained from a Radio Show on the Internet,
ACC had been targetted by Lamphere with Death Notices on a Bulletin
Board System, Pictures created by Mr. Lamphere, allegedly, which
depicted an executive of the American Computer Company with Rifle
Cross Hairs focused on him. According to eyewitnesses, letters
admonishing people to target ACC's president, and that he "belonged in
the crosshairs", and which called the American Computer Company's
staff various names, insinuations about their racial and genetic
heritage, sexual predispositions, family members intelligence and
mental states, parents visages, and dozens of other illegal and
slanderous messages, were sent ACC, using email or BBS posts or posted
on Lamphere's websites.
The assaults by allegedly began in December, after Lamphere posted
Press Releases indicating he and his former "NEXXUS" organization were
going to be involved in evaluating evidence in the possession of ACC,
a claim which American Computer Company immediately and categorically
denied, indicating they had no idea why Lamphere would publish such a
thing.
Lamphere's motto: "Don't start nuttin, there won't be nuttin" graced
his websites for the past two months while he repeatedly sent out
emails insisting that ACC was lying about his involvement with them.
He later admitted he had never before had any contact with ACC, but
for a few minute phone call, and that ACC had only ever had any
contact in return asking him to stop contacting them through lawyers
letters. Lampheres most recent attacks publically focus on lawyers
working for ACC, and on the local police department, indicating that
maybe some "crayons" were stolen by the persons who broke into ACC's
facility.
Among the alleged threats in his letters were phrases such as "I'll
shoot this off the top of your building, into a Public Eye", and the
expression "Right in my Crosshairs, where you belong, you (*&%", along
with the choice comment: "the best part of you ran down you mothers
leg".
American Computer Company has descretely published the headers and
status lines from the original criminal report of the break in at its
offices in August of 1997, on its website.
http://accpc.com/reportbe1.htm
When reached for comment, which did not include any comment about the
Court Case, ACC indicated that it had limited the police report
disclosure to those parts that did not release any sensitive parts of
the ongoing investigation, short of the victim, the report number, the
status and the date/charges. It indicated that ordinarily, a criminal
report is not to be published because it not only interferes with the
local police department's investigations, it tends to subject its
personnel to undue interference. It also commented that under public
law, theft of property is either UNDER 200 DOLLARs or OVER 200
Dollars. In this report's case, it was OVER.

NOTES FROM MODERATOR
No common lawsuit would be filed in "Supreme Court". The Supreme
Court of any state is the highest court of appeals. Cases reach there
only after being appealed from a lower court on some disputed point of
law.
Perhaps this is an honest mistake, and Wang means another new New
Jersey court. In that case, if he is looking at court records as the
first line indicates, he should be able to give the name of the court
(e.g. "Third District Court") and the case number. Both items always
appear on the first page of any court document. There are no "secret"
lawsuits. Once you file one, it becomes a matter of public record, so
there is no sense in Wang withholding this information. (Actually, all
you really need is the name and city of the court, because then you
can call the clerk for the case number.)
The court name would also appear on any legal documents that Lan
Lamphere is served with. You don't sue someone without serving papers
on them, and I assume that this would have to be done in person by a
process server, not just mailed.
If you have a court name and case number, here's how to obtain
records: Anyone can walk into the courthouse and examine the case
file, which is the easiest way. However, if you don't live near the
courthouse, you can obtain records by mail. First, call the court
clerk and ask them to mail you a copy of the "docket sheet" for the
case. This is a listing of all documents filed, their dates and
number of pages. The docket sheet would be only a page or two for a
newly filed case, and you can probably get a copy for free -- or at
most $2. Once you have the docket sheet, you can decide what documents
you want copies of. The original complaint is a good place to start.
Copies can get expensive -- usually $1 per page -- and most of the
paperwork is uninteresting, so you need to carefully select the
documents you request.
Of course, no lawsuit has actually been filed in this case.... The
real worry is that Shulman becomes so desperate that he does something
really stupid and self-destructive -- and hurts others in the process.
Jason Leigh holed himself up in the Waco VA building as his claims
unravelled, but he did it on a Sunday and didn't seem to want to hurt
anybody. Shulman, I sense, really does want to hurt people.
