Courtney Brown is not in the legal department, I hope!!!

Well my legal eagles say the case does apply, since the question
was whether the copier was a for-profit company.  Since the
question originated about Fortean Times, and they would re-sell
the photo as part of their magazine, and they are apparently
a for-profit enterprise, it would depend on the court to decide
whether it applies or not.

I think the fair use exemption was originally created for
Public Television and such.
